Selling a Property
No matter what your reason is for selling a property, we can work with you to ensure that the conveyancing process is completed as seamlessly as possible. We will ensure that you comply with your legal obligations and include all relevant disclosure information in the sales contract. We can also draft additional special conditions specific to your circumstances and to help protect your interests.
A written marketing contract must be prepared before selling residential property in the ACT and NSW. The contract will need to include prescribed disclosure material which may vary depending on the property and its location. The contract will show the legal description of the property and include details of any registered interests and encumbrances such as mortgages, easements, and restrictions. The items to be included and/or excluded from your sale should also be noted.
Generally, sellers will choose to sell their property by private treaty or auction. Your choice will depend on a range of factors, including the type of property being sold, the current state of the property market, and your personal preference.
In a private treaty sale, the property is listed for a fixed price or price range. Potential buyers can make offers on the property, and negotiations take place between the seller and the buyer to agree on a final sale price. It is common practice for the seller to appoint a sales agent to market the property and negotiate with potential buyers.
Auction is a method of sale where potential buyers bid on the property in an open and competitive environment. The property is listed for sale with a reserve price, which is the minimum price that the seller is willing to accept. The auction is held on a specific date and the highest bidder at the end of the auction is the successful buyer. One advantage of an auction is that it creates a sense of urgency among potential buyers. The auction date sets a deadline for the sale, which can help to speed up the sale process. Additionally, auction sales are transparent, as all potential buyers can see what other buyers are offering.
